Photography Terms & Conditions (service agreement)

1. Definitions

“Photographer” means Ale Kor, the provider of photography services.
“Client” refers to the person booking photography services.
“Session” refers to the agreed photo shoot (proposal, elopement, couple, wedding, portrait, etc.).
“Deliverables” refers to edited digital images delivered to the Client.
“Third-party services” refers to any additional services booked for the shoot (villas, boats, restaurants, transport, permits, etc.).

2. Booking and Agreement Formation

A booking is confirmed only after written confirmation by the Photographer and payment of the retainer (booking fee).

From the moment the retainer is paid, a binding agreement is formed. Planning, communication, location scouting, and date reservation are considered the start of service provision.

3. Cancellation, Refunds and Retainer

Client cancellation

Refunds depend on timing and whether third-party services have been booked.

  • 100% refund applies if cancellation is made more than 120 days before the session and no third-party services have been booked.
  • 50% refund applies if cancellation is made less than 120 days but more than 60 days before the session, and no third-party services have been booked.
  • If third-party services have already been booked or paid, refunds are reduced by all non-recoverable costs.
  • The retainer is non-refundable if cancellation occurs less than 60 days before the session.
  • Less than 30 days before the session or no-show: 100% of the session fee is due.

Exceptional circumstances (Client)

In cases of force majeure affecting the Client, including:

  • confirmed medical conditions or illness (with documentation)
  • flight cancellations or serious travel disruptions beyond the Client’s control
  • urgent family emergencies

The Photographer may, at their discretion:

  • offer rescheduling (subject to availability)
  • or consider a partial refund based on incurred costs and non-refundable third-party services

All decisions are made individually based on actual expenses.

Cancellation by Photographer

If the Photographer is unable to attend due to illness, injury, or other unforeseen circumstances:

The Photographer will first attempt to provide a replacement photographer of similar style and level.

If replacement is not possible or not accepted:

  • all payments, including the retainer, will be refunded
  • third-party services are refunded only if recoverable from providers

Liability is limited to amounts actually received from the Client.

4. Payment Terms

The remaining balance is due on the day of the session unless otherwise agreed in writing.

Failure to complete payment releases the Photographer from the obligation to deliver final images.

5. Delivery of Materials

Images are delivered digitally via online gallery within the agreed timeframe.

Selection and editing are carried out at the Photographer’s professional discretion.

RAW files are not provided unless agreed separately.

6. Refund Policy After Service Delivery

Once the session has taken place and/or final edited images have been delivered, the service is considered fully completed.

No refunds are issued in such cases.

Refunds are not available due to subjective expectations, editing style, weather, location conditions, or personal preferences.

7. Copyright and License

The Photographer retains full copyright of all images.

The Client receives a non-exclusive personal-use license for:

  • private use
  • printing
  • social media sharing (with credit where possible)

Commercial use is prohibited without written consent.

8. Portfolio Use

The Photographer may use selected images for portfolio, website, social media, and marketing purposes.

Full privacy is available upon request and is subject to an additional fee of 50% of the service price.

9. Force Majeure

Both parties are released from liability for failure to perform obligations due to force majeure, including but not limited to weather conditions, illness, accidents, travel restrictions, transport delays, government actions, and other circumstances beyond reasonable control.

In such cases, obligations are suspended and both parties will attempt to reschedule the session if possible.

If rescheduling is not possible, settlement is based on actual costs incurred by the Photographer, including non-refundable third-party expenses and organisational costs.

The retainer remains non-refundable once the service is considered started (including booking, planning, and preparation).

10. Limitation of Liability

The Photographer’s liability is limited to the total amount actually received from the Client for the specific session.

11. Acceptance of Terms

Payment of the retainer and/or booking confirmation constitutes full acceptance of these Terms & Conditions.
